The victim approaches Chanthabouly in the hallway and says, “what’s up.” Chanthabouly thinks he says, “what’s up blood” to him and retaliates with “I ain’t no gang member.” According to Chanthabouly, the victim becomes upset and Chanthabouly thinks he is a gang member. He shoots him in the head, and twice on the body.
